terms & conditions of design services

On this page you will find our Terms & Conditions of Contract for web design. When you register to have a website designed by us, you are agreeing to this terms and conditions. You should read these terms carefully as they do form a legal contract between us and our clients, and your acceptance of them is agreed upon your payment (be it a deposit or full payment) for our contracted services.

This contract covers the following:

Just Check Web Design Services as found on www.justcheck.co.uk
Just Check Web Consultancy as found on www.justcheck.co.uk
Just Check Web Design & Promotions as found on www.justcheck.co.uk
Web Hosting Free as found on www.webhostingfree.co.uk (if services are being used)

You should carefully read all the relevant sections that may apply to this contract as it is a legally binding document. Please also review Section 1 which is included within this agreement (you will receive Section 1 by email on registering for us to complete the work on your behalf).
This is section 2 which outlines the responsibilities of both parties. You will also receive a section 1, which outlines the work that we have agreed with you, and details the personal information that we are working on.

BOTH sections are governed by these Terms & Conditions as outlined below. Section 1 includes all the contact information that you will require should you need to discuss these matters.

DEFINITION OF TERMS:

The supplier (“we”, “us”, "I" or “our”) - Just Check Web Design, Web Hosting Free
The client (or you) - the entity which enters into a contract with Just Check Web Design & Promotions
Design Domain Name - the root address of a website, e.g. www.webaddress.com. All such names must be registered with the appropriate naming authority, which will usually charge a fee
Downtime - time when the website is not accessible via the Internet. This may be because of a technical failure of the Host or because work is being carried out on the site
Host - the company on whose system the Website physically resides
Hosting Service - A ISP or Server that provides the hosting for the website
Link, Hyperlink - a 'clickable' link embedded on a web page which may take the form of a graphic or text
Search Engine - a website which contains a directory of websites on the Internet enabling users to find websites by subject matter classification
Website - a collection of web pages and associated code which forms an integrated presence
The Work - the subject matter of the contract between the Client and Just Check Web Design, otherwise also referred to as Web Design Project
Contract Start Date – the date this contract is considered to be in force, or when the domain name was registered on behalf of the client, either at the clients written or verbal request, or when hosting commenced (if hosting on web hosting free servers)

1. Authorisation:
1.1 The client is engaging Just Check as an independent contractor for the specific purpose of designing and developing a World Wide Web site, herein after referred to as "Web Design Project", to be published on the Client's account, or to be hosted by Just Check on one of their servers, on an Internet Service Provider (ISP)/Web Presence Provider (WPP) computer, herein after refer to as "Hosting Service", or provided on diskette or CD-Rom at the Client's option (you will be charged an additional fee if you require a backup on disc including postage and packaging costs).
1.2 The Client hereby authorises Just Check to access this account, and authorizes the Hosting Service to provide Just Check with "full access" to the Client's account, and any other programs needed for this Web Design Project that are included as part of the Client's service agreement/level. The Client also authorizes Just Check to submit the completed Web Design Project to major Web Search Engines, as well as other well known web indexes, in order to assist in the promotion of the website.
1.3 This Web Design Project will be developed using HTML and/or ASP as required or agreed with the Client.
1.4 If the client then alters their decision and the project has already begun, then the client agrees that they will be liable for any costs up to the point of their decision, and such costs will have to paid by the client.
1.5 If for any reason the project cannot be run on the clients server then we will not be liable for this, as the project is designed to run on most servers, but we cannot guarantee server compatibility issues that may arise from clients using sub-standard server services.
1.6 Whilst the project is in development, we normally do this within one of our server web sites, and will provide a link for you to check and view the progress of the work. You should be aware that at this stage that you have:
1.6(a) Given us permission to use the images, text and any artwork that you may have supplied to us
1.6(b) Agree that we at this stage own the full copyright to the design project and as such, if you are to be found using or downloading project development files, you will be breaking copyright laws, and we will take legal action against you

2. Compatibility:
2.1 Designing a web site to fully work in multiple browsers (and browser versions) can require considerable, extra effort. It could also involve creating multiple versions of code/pages. Just Check represents and warrants that the web site they design for you will work in:
* Microsoft® Internet Explorer versions 5.5 and up
* Mozilla Firefox version 1.0 and up
2.2 While Just Check will make reasonable efforts to design a fully-functional web site, the warranty does not cover AOL, text-based browsers or requested special effects that we have advised you against.
For People with Disabilities – Just Check’s standard is to meet at least half the currently recommended guidelines for web site development. Without sacrificing quality and design, we try to ensure that the content and functions we build into our web sites are available to all visitors.
2.3 We take all reasonable precautions to ensure that any site is cross-browser compatible, but cannot guarantee the site against browser issues that may arise as browsers are always under constant development and alteration by their respective vendors.

3. FEES:
3.1. Fee(s) Payable. A non-refundable deposit of 50% of the total fee payable (hosting charges and domain name registration fees charged separately are to be fully paid at the Contract Start Date or whenever the domain name and registration has been purchased by Just Check on behalf of the Client – This figure is NOT included in the 50% deposit payment - Clause 3.2.4 for further information) under the contract is due immediately that -
3.1.1. We are authorised to commence work or
3.1.2. The domain name was registered on your behalf and hosting was approved or
3.1.3. Upon the signing of the contract which ever happens soonest. The remaining 50% shall become due when the website or amendments are published to the internet or the Work is completed to the reasonable satisfaction of the Client but subject to the terms of Clause 10.3 Approval of Work and Clause 10.4 Rejected Work hereof. Just Check Web Design reserves the right not to begin the Work until the said deposit has been paid in full. For new websites the contract will be inclusive of website design, build, * hosting and domain name (*charged separately), unless otherwise stated, inclusive for the first 12 months from the time that the website is published to the domain name. The client must provide a full statement of work covering the specific project work required. This must be signed by way of agreement by both Just Check Web Design and the client to the specific tasks together with cost estimates for the work involved.
3.2 Maintenance & Hosting fees. Hosting fees are not inclusive for new websites designed by Just Check Web Design (Clause 3.2.4 for further information).
3.2.1 Maintenance shall cover reasonable updates to the website content including text and images, but excludes structural / code changes. Such updates should be supplied on machine readable electronic format and delivered via e-mail, CD/DVD disc or USB memory stick. Updates covered by maintenance should not require any more than two hours work per month and will be charged at £16 per hour
3.2.2 Hosting fees are paid to a third party Internet Services Provider (ISP) by Just Check Web Design who hosts your website. Just Check Web Design is responsible for selecting the most appropriate ISP for your website and the first year cost for this service is not included for new websites design and built by Just Check Web Design, but will be billed separately. Continuous hosting for subsequent years provided that annual maintenance and hosting fees are maintained and that the client remains in credit with Just Check Web Design
3.2.3 For contract and /or outsourcing website services none of the above is applicable unless specifically agreed by both Just Check Web Design and the client as part of the statement of work
3.2.4 If you require domain name registration and hosting this is charged separately to the Web Design Project, and is payable in FULL as soon as the domain name is requested, and/or registered by us on your behalf. One month before the first and subsequent anniversary of the first publish date (or the date that the domain name was registered, whichever is the soonest) the client will be invoiced for the next 12 months hosting fees at the current hosting rate as stated on the Just Check Web Design Site
3.3 all payments are to be made within 14 days after completion and approval of the Web Design Project by the Client. In the case of development stages outlined in the Development Agreement, stage payments will be due within 7 days of stage completion
3.4 Failure to make any agreed stage payment will delay development, and may result in cancellation of this contract and loss to the client of their initial deposit and any previous payments made to Just Check. In case collection proves necessary, the Client agrees to pay all fees (including all legal fees and court costs) incurred by that process. This agreement becomes effective only when signed by Just Check, or if you have verbally agreed to the Web Design Project, or have validated this intention through email, or letter
3.5 All payments will be made in Pounds Sterling, all cheques to be made payable to Just Check

4. Web Site Maintenance:
4.1 This agreement allows for minor web site maintenance to pages for the first 60 days of your web site at no charge, up to an average of 10 minutes per regular web page (or 6 pages) whichever is the greatest, including updating links and making minor changes to a sentence or paragraph. It does not include replacing nearly all the text from a page with new text, major page reconstruction, major page redesign, new pages, new images, guestbook’s, discussion webs, navigation structure changes, attempted updates by Client repairs or Web Design Projects delivered to Client via diskette or CD-Rom, mail and e-mail. The period begins on the date the Client's web site is available to be published to the Client's hosting service. Major page code and/or graphics changes and additions will be charged at the £18.00 per hour rate (or a pre-agreed rate between the client and ourselves) -
Notice: This rate is subject to change at any time
4.2 The client will be given instructions on how to modify text areas so they can update sections at their own discretion (if they are hosting the site on their own servers), but the client should be aware that any modifications within text areas are made entirely at their own risk, and whilst we can offer advice on how a project can be edited, we do not guarantee that the changes made by the client will not cause problems within the web site itself. Furthermore, if a client does modify areas of their web site, which then causes issues within the site, then they do so at their own risk, and we will not be held accountable to have to rectify the problem(s) freely
4.3 Should a client wish to edit text areas or upload new additional images themselves, we recommend that they do not use WYSIWYG editors or online server provided editing software, as some of these forms of software can render parts of the background coding inoperable, and we bear no responsibility for this. Ideally the client should use Text based editors such as Notepad, or Araneae which is a FREE suitable alternative that will allow you to edit text areas without introducing un-necessary coding. You can download Araneae by clicking this link. By using such editors you can be more confident that any corrections you make will not affect coding (unless of course you alter the coding). These text editors are text based only – in other words, you will not be altering pages in design view, but rather in code view
4.4 if a client would like to upload their own images in addition to the images provided by us, then we suggest that they use Adobe Photoshop to edit and design the images. Adobe Photoshop may be downloaded from the Adobe site by clicking this link
4.5 we do not provide a means for you to edit sites on our servers currently, but depending on the type of package we have agreed with you, then Just Check will make the changes upon your behalf, subject to the clauses and conditions within this contract. That is why we recommend the All-In-One Designs Solution from us

5. Electronic Commerce Laws:
5.1 The Client agrees that the Client is solely responsible for complying with any laws, taxes, and tariffs applicable in any way to the Web Design Project or any other services contemplated herein, and will hold harmless, protect, and defend Just Check and his subcontractors from any claim, suit, penalty, tax, fine, penalty, or tariff arising from the Client's exercise of Internet electronic commerce and/or any failure to comply with any such laws, taxes, and tariffs

6. Assignment of Web Design Project:
6.1 Just Check reserves the right, and you hereby agree to assign subcontractors to this Web Design Project to insure that the terms of this agreement are met as well as on-time completion

7. Copyrights and Trademarks:
7.1 The Client unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, music, other artwork, or anything furnished to Just Check for inclusion in the Web Design Project are owned by the Client, or that the Client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, indemnify and defend Just Check and his subcontractors from any liability (including attorney's fees and court costs), including any claim or suit, threatened or actual, arising from the use of such elements furnished by the Client
7.2 Any logos, images, graphics or otherwise, that we have designed or modified for the project remain under our design copyright, and as such, should the client then re-design their own website, that they are not permitted to include any modified images, or artwork, or logos that we have created specifically in relation to this project
7.3 The client retains their own copyright to their own “original” and un-modified images, or text that they have supplied for use in connection with the project

8. INTELLECTUAL PROPERTY RIGHTS:
8.1 Offers and Proposals
Offers and proposals made by Just Check Web Design to potential clients should be treated as trade secrets and remain the property of Just Check Web Design. Such offers and proposals or the information contained within them must not be passed to third parties or publicly disseminated without prior written authorisation from Just Check Web Design. This includes, but is not limited to, technical features, functionality, aspects of the design and pricing information.
8.2 Warranty by Client as to Ownership of Intellectual Property Rights
The Client will obtain all the necessary permissions and authorities in respect of the use of all copy, graphic images, registered company logos, names and trademarks or any other material it supplies to Just Check Web Design for inclusion on the Website. The conclusion of a contract between Just Check Web Design and the Client shall be regarded as a guarantee by the Client to Just Check Web Design that all such permissions and authorities have been obtained and that the inclusion of such material on the Website would not constitute a criminal offence or civil delict. By agreeing to these terms and conditions, the Client removes the legal responsibility of Just Check Web Design and indemnifies the same from any claims or legal actions however related to the content of the Client's site.
8.3 Domain Name
Any Domain Name obtained will belong to the Client (if purchased on behalf of the client, but if the client requests a transfer of the domain name to another service provider, or web design company, then Just Check reserve the right to make any applicable charges that will be involved in the transfer process. This fee can be anything of £80.00 upwards plus VAT depending on current Nominet Charges at that time). The Client agrees to indemnify Just Check Web Design, including any incidental costs, against any claims that a Domain Name applied for, or obtained, violates the intellectual property rights of a third party. The Client warrants that the domain name sought is not a trademark of a third party.
8.4 Licensing
Once Just Check Web Design has received full payment of all outstanding invoices and the Work has been approved by the Client in accordance with Clause 10.3 hereof, the Client will be granted a licence to use the Website and its contents.
8.5 Trade Secrets
Any code that is not freely accessible to third parties and not in the public domain, and to which Just Check Web Design or their suppliers owns the copyright, may not be copied, published, distributed or passed to any third parties in any form without prior written consent from Just Check Web Design. Unless previously agreed otherwise in writing, no modifications may be made by the Client or any third party to code to which Just Check Web Design or their suppliers owns the copyright. Just Check Web Design acknowledges the intellectual property rights of the Client. Information passed in written form to Just Check Web Design, and that the Client has indicated is confidential or a trade secret, will not be published or made available in any other way to third parties without the prior written consent of the Client.

9. Web Design Project Copyright:
9.1 Copyright to the finished web design site produced by Just Check will be owned by Just Check. The Client will be assigned rights to use the Web Design Project as a web site, once final payment under this agreement and any additional charges incurred have been paid, however they must agree that Just Check owns the copyright on any wording included within the site, images, or logos, they have personally designed
9.2 Rights to photos, graphics, source code, work-up files, and computer programs specifically are not transferred to the Client, and remain the property of their respective owners. Just Check and his subcontractors retain the right to display graphics and other Web Design elements as examples of their work in their respective portfolios
9.3 All Web Design Projects will contain a copyright/legal statement with a link (image links may be included) to Just Check’s web site
9.4 Any source files have a copyright statement on the coding (such as CSS files that have been specifically designed by us) to create the look and the feel of the project. The client is not permitted to remove any such copyright statements from such source files – these statements do not infringe on a sites ranking as they only appear within the coding itself
9.5 The client is permitted to add additional text, and alter textual statements to suit their own wording, but should be aware that we will not be liable for any additions that may either be:
9.5(a) Cause disruption to the working page or site
9.5(b) Contain libellous statements
9.5(c) Infringe upon anyone else’s copyrights
9.5(d) Infer that their content was the work of Just Check
9.5(e) Indemnify Just Check that any additions or modifications were not made by us, but by the client themselves
9.6 Just Check will deliver the project and at that time, will retain a “as-is” backup of the original project as provided to the client. This backup will be available to the client at any time within the first 60 days of the hand-over should they cause some problems to their new site
9.7 Should the client by altering their site make it appear in our opinion, detrimental to our original production, then we fully reserve the right to end the contract and -
9.7(a) Request that they remove our link
9.7(b) And cease using any of the supplied images that we have personally created on their behalf

10. COMPLETION OF WORK AND PAYMENT:
10.1 Completion of Work
Just Check Web Design warrants completing the Work in accordance with its Standard Terms and Conditions to the specifications previously agreed with the Client. Just Check Web Design will not charge more than the amount previously agreed unless the Client has varied the specifications of the Work since the agreement. Just Check Web Design will not undertake changes to the specifications of the Work which would increase the cost, without prior written authorisation from the Client.
10.2 Supply of Materials
The Client is to supply all materials and information required for Just Check Web Design to complete the Work in accordance with the agreed specification. Such materials may include, but are not limited to, photographs, written-copy, logos and other printed materials. Where the Client's failure to supply such materials leads to a delay in completion of the work, Just Check Web Design has the right to extend previously agreed deadlines for the completion of the Work by a reasonable amount. Where the Client's failure to supply materials prevents progress on the Work for more than 21 days, Just Check Web Design has the right to invoice the Client for any part or parts of the Work already completed. Furthermore, if the client fails to deliver materials within a further 21 days Just Check Web Design reserves the right to invoice the full amount of the contract value for which immediate payment will be required. See section 10.6 for Remedies for overdue payments.
10.3 Approval of Work all work whether for new websites, contract work and or outsourcing to Just Check Web Design shall be carried out on machines owned by Just Check web Design. All work is submitted to a demonstration site for approval before any work is published to the internet (World Wide Web) and/or released to the client. The approval process consists of:
Initial design
the initial design will be made available to the client on a demonstration site. The client will be provided with a link to this site via email. The client may request modifications to this site within 15 days of notification. The initial design may not contain client data but that this will be represented with sample text and images to represent font, style, colours and placement. Once the initial design is approved the full website will be built to this design and progress will be published to the demonstration site. The client may access this site throughout the entire process until completion amendments and refinements may be made during this phase. On completion of the Work, the Client will be notified and have a further opportunity to review it on the demonstration site. The Client should notify Just Check Web Design, in writing, of any unsatisfactory points within 7 days of receipt of such notification. Any of the Work which has not been reported in writing to Just Check Web Design as unsatisfactory within the 7 day review period will be deemed to have been approved and the site will be published to the domain name. Once approved, or deemed approved, work cannot subsequently be rejected, and the contract will be deemed to have been completed and the 50% balancing payment under Clause 3.1 Fee Payable will become due. The Contract will remain in effect until all obligations have been completed in terms of this Clause.
10.4 Rejected Work
If the Client rejects the Work within the 7 day review period, the website will not published to the domain. Or if client will not approve subsequent Work performed by Just Check Web Design to remedy any points reported by the Client as unsatisfactory, and Just Check Web Design considers that the Client is unreasonable in repeated rejection of the Work, the contract will be deemed to have expired and Just Check Web Design can take any legal measures to recover both payment for the completed Work and reasonable expenses incurred in recovering payment.
10.5 Payment
Upon completion of 7 day review period, Just Check Web Design will invoice the Client for the 50% balancing payment in accordance with Clause 3.1 Fee Payable hereof, which, in the absence of agreement to the contrary, is to be paid by the Client within 7 days of the date that the invoice was issued.
10.6 Remedies for Overdue Payment
If payment has not been received by the due date, Just Check Web Design has the right to revoke any discounts or special offers that the client was offered, suspend ongoing work for Client, and suspend the hosting service for the domain name until such time that full payment of the outstanding balance has been received. If full payment has still not been received 21 days after the due date, Just Check Web Design has the right to replace, modify or remove the Website and revoke the Client's licence of the Work until full payment plus 15% administration fee has been received. By revoking the Client's licence of the Work or removing the web site from the Internet, Just Check Web Design does not remove the Client's obligation to pay any outstanding monies owing. Legal / recovery fees in regard to securing payment incurred by Just Check Web Design is the responsibility of and recoverable from the client.

11. Completion Date:
11.1 Just Check and the Client must work together to complete the Web Design Project in a timely manner. We agree to work expeditiously to complete the Web Design Project no later than *30 days (*depending on the project complexity) after Client has submitted all necessary materials. If the Client does not supply Just Check with complete text and graphics content for this Web Design Project within 30 days of the effective date of this agreement, the entire deposit amount of the agreement shall be retained by Just Check as liquidated damages and the contract shall become null and void, at Just Check’s option, unless the Web Design Project is cancelled in writing by the Client prior to 14 days of the effective date of the agreement
11.2 A day means a “working day”. Working days are Monday to Friday inclusive. Weekends are not counted as working days (unless otherwise agreed)

12. Project Delivery:
12.1 The final web site design project will be published to the Client's hosting service upon receipt of final payment or delivered via diskette or CD-Rom upon the receipt of full payment. The Client understands that Just Check may not provide any hosting services in connection with this Web Design Project (unless otherwise agreed). Hosting services may require a separate contract with the hosting service of the Client's choice, or if provided by Just Check, then clause 3.2.4 will apply
12.2 If the Client wishes to use a Hosting Service of their choice, the client agrees to select a hosting service which allows Just Check full access to the Client's account via FTP (File Transfer Protocol). The Client will be solely responsible for any and all hosting service charges and for any disruptions to their services, and this agreement, if their hosting services cannot provide adequate details and information to install a working site to their servers

13. RIGHTS AND RESPONSIBILITIES:
13.1 Right to Terminate
Just Check Web Design reserves the right to refuse or break a contract without prior notice, if it is believed that the Client, their Website, or any material is illegal, immoral or otherwise unacceptable.
13.2 Events Beyond the Control of Just Check Web Design
Just Check Web Design will not be liable for breach of contract where that breach was due to software, hardware or electrical failure, natural events such as fire, flood or other events beyond the control of Just Check Web Design.
13.3 Supply and Pricing of Services
Just Check Web Design reserves the right to use whoever it feels appropriate at the time for third party software and services, and to alter its prices as necessary without prior notice and without affecting existing contractual pricing agreements.

14. DISCLAIMERS:
14.1 Third Parties
Just Check Web Design can take no responsibility for services provided by third parties through us or otherwise, including the Hosting of the Client's Website, although Just Check Web Design will endeavour to ensure that Website downtime is kept to a minimum. That being said Just Check Web Design only contracts hosting to third parties who provide a guaranteed 99.95% uptime.
14.2 Maintenance and Correction of Errors
Just Check web Design takes no responsibility for the functionality or maintenance (unless a maintenance contract is in place) of the Website after the Work has been completed. Errors (both technical and typographical) attributable to Just Check Web Design will be corrected free of charge, but Just Check Web Design reserves the right to charge a reasonable fee for correction of errors for which Just Check Web Design is not responsible, including, but not limited to malicious modification of the Website by a third party and typographical errors contained in materials provided to Just Check Web Design by the Client.
14.3 Extent of Work
Installation on the Internet is limited to the uploading of all necessary files to the Host of your domain name, and testing of functionality. No registration of the Website with Search Engines will be undertaken unless otherwise agreed with the Client.
14.4 Consequential Loss
Under no circumstances will Just Check Web Design be responsible or liable for financial or other loss or damage caused by the failure or use or misuse of its software. The Client should ensure that data on their site is regularly backed up and that a contingency plan is in place to minimize possible losses as a result of software failure. The client may request a full copy of the completed work for back up security purposes. Any request shall not be reasonably denied provided that the client has paid in full all outstanding amounts due to Just Check Web Design.
14.5 Status and Duration of Offers
Proposals and offers are valid for a period of 15 days from the date issued. Just Check Web Design is not bound to honour offers that have expired. Offers are not legally binding until an acceptable timetable for the work has been agreed by both parties. This timetable must be agreed within the 15 days that the offer is valid. If an acceptable timetable has not been approved by both parties within 15 days of the offer being made, the offer is deemed to have expired.
14.6 Search Engine Listings
Just Check Web Design does not guarantee listings on Search Engines and the Client accepts that it is Search Engines and not Just Check Web Design who determine whom they list, what they list and whom / what they will not. The Client further understands there is no guaranteed placement or rank on the Search Engines and that a new website may never even appear on Search Engines at all. Just Check Web Design does not control Search Engines’ algorithms and huge shifts can appear daily, weekly and even hourly.

15. INTERPRETATION:
15.1 Jurisdiction
This Agreement shall be governed by the laws of England which shall claim venue and jurisdiction for any legal action or claim arising from the contract between Just Check Web Design and the Client. The said contract is void where prohibited by law.
15.2 Survival of Contract
where one or more terms of the said contract are held to be void or unenforceable for whatever reason, any other terms of the contract not so held will remain valid and enforceable at law.

16. CHANGE OF TERMS AND CONDITIONS:
These terms & conditions may change from time to time. The Client will be informed of revisions as and when they are issued.

17. Legal & Privacy Notice:
17.1 Notwithstanding anything to the contrary contained in this contract, neither Just Check nor any of its employees or agents warrants that the functions contained in the Web Design Project will be uninterrupted or error-free. The entire risk as to the quality and performance of the Web Design Project is with the Client
17.2 In no event will Just Check be liable to the Client or any third party for any damages, including, but not limited to, service interruptions caused by Acts of God, the Hosting Service or any other circumstances beyond our reasonable control, any lost profits, lost savings or other incidental, consequential, punitive, or special damages arising out of the operation of or inability to operate this Web Design Project, failure of any service provider, of any telecommunications carrier, of the Internet backbone, of any Internet servers, you or your site visitor's computer or Internet software, even if Just Check has been advised of the possibility of such damages
17.3 You should also review our full legal and privacy statements as posted within our web site to understand how we view these issues

18. This Agreement:
18.1 This agreement constitutes the sole agreement between Just Check and the Client regarding this Web Design Project
18.2 any additional work not specified in this contract or any other amendment or modification to this contract must be authorised by a written request signed by both Client and Just Check. You should send us any instructions that you have by writing or by email (Whilst we have no objections to discussing requirements by telephone, we will only act upon written authority or instructions to avoid any misunderstandings)
18.3 All prices specified in this contract will be honoured for 4 months after both parties sign this contract. Continued services after that time will require a new agreement, or an additional noted agreement, about which extra services the Client may require
18.4 this agreement includes Section 2 which stipulates your requirements, and any notes, or information that we have provided to you
The undersigned hereby agree to the terms, conditions and stipulations of this agreement on behalf of his or her organization or business

19. Payment Terms, Prices & Schedule:
19.1 Payment for services provided hereby shall be made in accordance with the conditions contained in this contract and the Package Price, attached hereto and made a part of this agreement hereof. Notwithstanding any prices listed in literature or on Web pages, the Client and Just Check agree that the services described in this contract (PLEASE REVIEW SECTION 1 for the full details of our agreement with you), and the Package Price
