DEFINITION OF TERMS:
The supplier (“we”, “us”, "I" or “our”) - Just Check Web Design, Web Hosting Free
The client (or you) - the entity which enters into a contract with Just Check Web Design & Promotions
Design Domain Name - the root address of a website, e.g. www.webaddress.com. All such names must be registered with the appropriate naming authority, which will usually charge a fee
Downtime - time when the website is not accessible via the Internet. This may be because of a technical failure of the Host or because work is being carried out on the site
Host - the company on whose system the Website physically resides
Hosting Service - A ISP or Server that provides the hosting for the website
Link, Hyperlink - a 'clickable' link embedded on a web page which may take the form of a graphic or text
Search Engine - a website which contains a directory of websites on the Internet enabling users to find websites by subject matter classification
Website - a collection of web pages and associated code which forms an integrated presence
The Work - the subject matter of the contract between the Client and Just Check Web Design, otherwise also referred to as Web Design Project
Contract Start Date – the date this contract is considered to be in force, or when the domain name was registered on behalf of the client, either at the clients written or verbal request, or when hosting commenced (if hosting on web hosting free servers)
This page explains how we will deal with and look after your personal information that you may supply to us, and what this means for you. Having run our own business already, we are fully conversant with Client Confidentiality. As such, this means that when you deal with Just Check, you are dealing with "Us". We will safeguard your information and keep all transactions, communications and details PRIVATE. This means that any information you share with us will only be used by us in connection with our dealings between both parties. Some of our clients have to entrust with us with very presonal information such as login names, passwords etc. All this information is used in the strictest confidence and maintained in a safe and secure environment.

Just Check Anti-SPAM Policy:
Just Check Anti-SPAM Policy Just Check Web Promotions & Advertising (hereinafter referred to as “Just Check or we, us, our or I”) and the Client (hereinafter referred to as "Client or you") This policy is subject to change, so please check regularly for updates. This policy is in addition to Just Check Terms and Conditions which can be found by clicking this link where our legal policy is shown.
1. You will not send SPAM, or any unsolicited commercial email from our network, or promote a website hosted on our network using SPAM. We reserve the right to determine what constitutes SPAM and terminate all services, without prior notice, of any customer disregarding this policy. YOU WILL BE CHARGED A 'CLEAN UP' FEE OF £500 PLUS AN ADDITIONAL £200 PER HOUR ADMINISTRATIVE CHARGES FOR ACCOUNTS TERMINATED OR SUSPENDED DUE TO SPAM.
2. Web Hosting customers are permitted to send confirmed 'opt-in' bulk-email to Mailing Lists of up to 500 recipients per hour and a maximum of 3000 recipients per day. If you exceed this limit or if such email is reported as SPAM then clause 1 of this policy will be applied. IF YOUR ACTIONS CAUSE OUR MAIL SERVERS OR ANY OF OUR IP ADDRESSES TO BE BLACKLISTED (THIS INCLUDES BUT IS NOT LIMITED TO ANTI-SPAM ORGANISATIONS, MAIL FILTERING SYSTEMS, RBL LISTS, INTERNET SERVICE PROVIDERS) YOU WILL BE CHARGED £500 PLUS AN ADDITIONAL £200 PER HOUR ADMINISTRATIVE CHARGES INCURRED TO REMOVE AND PROTECT MAIL SERVERS AND IP RANGES.
3. You will represent, undertake and warrant to Just Check that any bulk-email, sent either using the services provided by us or to promote a website or domain held on the Just Check Network, will comply with the terms below. Any bulk-email that does not comply with these terms will be treated as SPAM and clause 1 of this policy will apply:
3.1 Every email must clearly state who the sender is and give clear and precise instructions on how to be removed from receiving any further communications of the same or similar nature. The removal instructions shall be easy to understand and must aid and not hinder the subscriber.
3.2 You shall ensure that before the sending of any bulk-email you have received back a 'Subscription Confirmation Request' from each recipient's email address that proves that the recipient did in fact 'opt-in' to receiving communications of this kind. If you do not have such proof then it will be treated as SPAM and clause 1 of this policy will be applied.
3.3 You shall ensure the 'Subscription Confirmation Request' sent to the recipient to confirm 'opt in' of bulk-email shall not be an advertisement for products or services.
3.4 Every email must comply fully with UK and European Laws 4. To prevent the sending of bulk unsolicited email and to prevent the IP addresses of Just Check being blocked by IP address blocking, then clause 1 of this policy will be applied, in the following scenarios: -
4.1 Where we have received any complaints concerning unsolicited email originating from a Just Check hosted domain.
4.2 Where we have received any complaints concerning unsolicited email being sent to promote web sites and domains that are hosted on the Just Check network. This also includes domains which use the Just Check domain forwarding service.
4.3 Where bulk-email is sent to a 'dirty list' of unconfirmed 'opt-in' email addresses.
4.4 Where bulk-email is sent to email addresses harvested from the Internet.
4.5 Where bulk-email is sent to email addresses obtained from another party, even if the other party claim the list is 'opt-in'.
4.6 Where you have not put in place adequate protection to prevent web applications and scripts from sending unsolicited spam email for your web site.
5. Nothing in this policy is intended to grant any right to transmit or send email to, or through, the Services provided by Just Check. Failure to enforce this policy in every instance does not amount to a waiver of our rights.
6. Unauthorized use of the Services in connection with the transmission of unsolicited email, including the transmission of email in violation of this policy, may result in civil, criminal, or administrative penalties against the sender and those assisting the sender.
7. We reserve the rights to collect information from you when you complete our online contact forms, such as registering your IP Address, browser details, and originating page information.
7.1 Where it can be proved that you have been submitting spam to us, we will pass on this information to the authorities in order to prevent needless spamming of our contact pages.
